: : I'm a single mom with two kids. I own my home ( or at least I make the payments ), have a 95 van, and that's about it. I have less than $5,000 in debts other than the home, but the creditors are calling me daily and I just can't handle it anymore. I work from home, but my business has taken a huge drop and I'm barely making it. My family keeps telling me to file bankruptcy, but I'm scared of it. I don't what to lose my home, it's the only thing I have left , and I don't want to lose my car. I'm completely ignorant on the legalities of this, so I wanted to ask . Will they take my house if I file ?

: Every one is scared and nervous when they file, that is completely normal. The very best thing you can do is talk to an attorney. A lot of them give you a free consultation. I suggest you make an appointment as soon as possible. It is better to know what your options are. Some times that really helps eliminate some of the fear and apprehension. I would do that sooner then later before the new laws take affect in Oct. Chances are good that you will not lose your house and your car. That depends on how much equity you have in them. The car being a 95 probably will be exempt. There are a lot of people on this forum much more knowledgable than me and I'm sure they will chim in soon. I have really depended on this forum to help get me through this awful time. Cheryl don't be scared, you will be ok. Your family is probably right. I don't think it matters how much debt you have, if you can't pay it, you can't pay it. Hang in there, you will be ok.

Ditto from me. We can all sure feel your pain about the fear and apprehension in filing BK. We paid our debts regularly for several years and then got blindsided by a medical issue. We avoided filing for months. I just felt like it was giving up. But then reality set in and robbing Peter to pay Paul didnt work any longer. The bottom line is if you can't pay it then do consult an attorney and see what your options are. Good luck - we are all here for you....
